The Enforcement Directorate (ED) has got a leg up in its ongoing endeavours under the Prevention of Money Laundering Act (PMLA). The Supreme Court of India has upheld the validity of various provision of this Act which is otherwise considered draconian. The verdict of the Supreme Court was in response to a number of petitions against the harsh provisions of the PMLA legislation including the power of the ED to convert any case into an offence of money laundering. As part of its verdict the SC has also upheld the ED’s power to arrest. This is a set-back to a number of high profile personalities accused by the ED of money laundering.
